These Terms of Use govern access to and use of the Gestiva 360 platform (the “platform” or the “service”). By subscribing to or using the service, you confirm that you have read and accepted these terms.

1. Acceptance

Using the platform means you accept these terms in full. If you do not agree with any condition, you should not use the service.

2. Description of the service

Gestiva 360 is a digital platform for fleet operations management that brings fueling, maintenance, field checklists, operator management and indicators together in a single environment. We may evolve, change or discontinue features at any time, with notice when applicable.

3. Registration and account

You are responsible for the accuracy of the information you provide and for keeping your login credentials safe. Activity carried out in your account is your responsibility, and you must report any unauthorized use immediately.

4. Permitted use

When using the platform, you agree not to:

use the service for unlawful purposes or in ways that violate the rights of others;
attempt to access areas or data without authorization;
interfere with the security, stability or integrity of the platform.

5. Data and privacy

Personal data is handled under our Privacy Policy, which forms part of these terms. Operational data entered on the platform remains the property of the customer.

For personal data of employees, drivers and third parties that the customer enters or generates on the platform, the customer acts as the controller and Gestiva 360 as the processor, under Brazil’s LGPD. The customer is responsible for defining the purposes of processing, ensuring an appropriate legal basis, informing data subjects and handling requests to exercise their rights. We process this data according to the customer’s instructions and the Privacy Policy.

Features that capture images or geolocation during time clock punches and inspections are optional and enabled by the customer. By enabling them, the customer confirms it has a legal basis for the collection and has informed the data subjects.

6. Intellectual property

The platform, its brand, code, layout and content belong to Gestiva 360 and are protected by law. Using the service does not transfer any intellectual property rights to the user.

7. Availability and liability

We make efforts to keep the platform available and secure, but the service is provided “as is”. We are not liable for unavailability caused by factors beyond our reasonable control, nor for operational decisions made based on information from the platform.

8. Term and termination

These terms remain in effect for as long as the relationship between you and Gestiva 360 lasts. Access may be suspended or terminated if these terms are breached.

9. Governing law and jurisdiction

These terms are governed by the laws of Brazil. The courts of the district where Gestiva 360 is headquartered are chosen to settle any disputes, unless the law provides otherwise.
